The Federal Trade Commission (FTC) is charged with preventing deception and unfairness in the marketplace. The FTC Act gives the Commission the power to bring law enforcement actions against false or misleading claims that a product is of U.S. origin. Traditionally, the FTC has required that a product advertised as Made in USA be “all or virtually all” made in the U.S.
In 1997, following consumer research and public comments, the FTC published an Enforcement Policy Statement on U.S. Origin Claims (the Made in USA Policy Statement) to guide marketers who want to make an unqualified Made in USA claim under the “all or virtually all” standard and those who want to make a qualified Made in USA claim. In this context, an “unqualified” claim is a claim without conditions or caveats. A “qualified” claim is a claim with limitations or other explanations.
In August 2021, the FTC finalized the Made in USA Labeling Rule, (the Labeling Rule), available at 16 C.F.R. Part 323. The Labeling Rule codified the “all or virtually all” standard for labels on products. Marketers are now subject to civil penalties if they use an unqualified Made in USA label on a product that is not “all or virtually all” made in the U.S., including in catalogs or online.
This publication provides additional guidance about how to comply with the “all or virtually all” standard. It also offers some general information about the U.S. Customs and Border Protection’s (CBP) requirement that all products of foreign origin imported into the U.S. be marked with the name of the country of origin.

The Department of Commerce’s First-of-its-Kind Supply Chain Center The Supply Chain Center (SCC), which is housed in the Industry and Analysis unit (I&A), is increasing the resilience of select critical supply chains. Supply Chain Services Who We Are The Office of Supply Chain Services (SCS) supports the mission of the International Trade Administration by delivering expertise on transportation, logistics, and distribution services through industry analyses, cross-sector engagements, and trade policy development and trade negotiations.
Supply chain services are fundamental to the functioning of both U.S. and global supply chains and are essential to the strength and competitiveness of the U.S. economy.
What We Cover Supply chain services include the modes of transportation and the logistics and distribution services that facilitate the movement of goods into, out of, and throughout the United States and around the world. SCS covers a range of transportation industries, including air, maritime and ports, rail, and trucking, as well as logistics and distribution services, such as cold chain, e-commerce, express delivery, franchising, retailing, and warehousing, among others. Supplier Scouting The U.S. faces supply chain challenges that impact our nation’s security and economic health as well as our well-being and safety. Extensive offshoring and outsourcing have resulted in U.S. manufacturing falling behind. Small and medium-sized manufacturers (SMMs) are especially challenged with sustaining operations in light of current supply chain conditions. There is a widespread need to find domestic manufacturing suppliers to meet current needs.
The MEP National Network’s (MEPNN) Supplier Scouting service can be applied on a national, regional, or local scale. By leveraging our extensive relationships and knowledge of U.S. manufacturing capabilities, we identify U.S. manufacturers with specific production and technical capabilities and connect them to new customers in the supply chains of larger companies and government agencies. Additionally, we identify and connect domestic suppliers with purchasers, responding to the specific needs of agencies to meet Build America, Buy America requirements.

U.S. manufacturers have the capabilities and capacities to produce any item needed by our nation’s supply chains. The MEPNN’s supplier scouting service provides a viable means by which domestic manufacturing suppliers can be catalyzed to produce needed items domestically.
MEP National Network Supplier Scouting Process The MEPNN Supplier Scouting process is straight-forward and easy for the requesting company or federal government agency. Below are the basic steps:
Government agencies with supply chain needs can use the MEPNN Supplier Scouting service by completing a Supplier Scouting Opportunity Synopsis form. Companies with supply chain needs should contact their local MEP Center NIST MEP disseminates the information to MEP Centers in every state and Puerto Rico to conduct a nationwide search for U.S. manufacturers with the capabilities and business interests to supply the needed item. The results are summarized by NIST MEP and reported to the organization that submitted the request. MEPNN Supplier Scouting typically takes 30-45 days to return results. Contact your local MEP

Eligibility Overview U.S. Commercial Service (CS) - Mission Statement
U.S. Commercial Service (CS) assists and advocates for U.S. businesses in international markets to foster U.S. economic prosperity. Utilizing our network of trade promotion and policy professionals located in over 80 countries and 100 U.S. locations, CS promotes U.S. exports, especially among small and medium-sized enterprises; advances and protects U.S. commercial interests overseas; and attracts inward investment into the United States.
CS’s Client Eligibility Policy (CEP) is consistent with the U.S. Department of Commerce’s strategic goal to drive U.S. innovation and global competitiveness by increasing U.S. exports and ensuring more U.S. regions and workers benefit, including those from underserved communities.
