米国輸出規制 - Export Administration Regulations (EAR)

EARとは、米国商務省産業安全保障局 (BIS: Bureau of Industry and Security)が管轄している法律です。　米国から¹Dual-Useの²アイテム（貨物（汎用品）、ソフトウェア、技術）を海外へ輸出する時に適用されます。　又、米国以外の国から第三国へ再輸出する時にも適用されますので、米国製品を扱う日本企業も注意を払う必要があります。　

注： 米国輸出規制は、米国商務省の他に、米国国務省、米国エネルギー省、米国財務省が担当しています。　ここでは、商務省が管轄している輸出規制についてのみ説明致します。　

1. 軍事用に転用可能な二重用途品といわれるもの
2. 貨物（汎用品）、ソフトウェア、技術をまとめてアイテム(品目)といいます。　

どのようなDual-UseアイテムがEARの対象となるのでしょうか？　

米国内にあるもの
－　米国にあるすべての品目

米国外にあるもの
－　米国で生産された品目、米国原産品目　(所在に関わらず)
－　外国製品で、特定の割合を超えて米国規制品目が含まれている製品　
(組み込み品)　
－　外国製品で、特定の米国規制技術が使用されている製品（直接製品）

その他
－　米国人・米国人以外の外国人の特定の活動
－　技術やソースコードの外国人への移転
*　技術移転や、ソフトウェアのソースコードの開示なども輸出とみなされます。　

EARの対象品目のすべてに商務省からの輸出（再輸出）許可が必要というわけではありません。　許可が必要か否かは、

1. 何を輸出するか？
2. どの国へ輸出するか？
3. 誰が受け取るか？
4. 何のために使用されるか？

によって決定します。

CCLとECCNとEAR99

CCL：規制品目リスト(CCL: Commerce Control List) に記載されているものは、EAR対象品目のなかでもセンシティブなものです。　

ECCN：CCLにリストされている品目には、規制品目番号（ECCN: Export Control Classification Number)がついています。　　

EAR99：CCLに載っていないEAR対象品目は、EAR99というカテゴリーに分類されます。　EAR99は、主にローテクの消費財が多く、商務省のライセンスなしで輸出可能な場合が多くあります。　注：但し、EAR99もEAR対象品目なので、制裁国、テロ支援国などへ輸出（再輸出）する場合には、ライセンスが必要な場合があります。　

ECCNの構成

ECCNはアルファベットと数字の組み合わせで、最初の２桁で、その品目が何であるかがわかります。１桁目の数字が、CCLのカテゴリー、２桁目のアルファベットが製品のグループを示します。　例えば、３A001は、初めの３がエレクトロニクス、Aはシステム、備品、コンポ－ネントであることを表します。　

５D002だとそれが暗号ソフトウェアだとわかるわけです。

Global Business Navigator Chatbot Beta

Welcome to the Global Business Navigator, an artificial intelligence (AI) Chatbot from the International Trade Administration (ITA). This tool, currently in beta version testing, is designed to provide general information on the exporting process and the resources available to assist new and experienced U.S. exporters. The Chatbot, developed using Microsoft’s Azure AI services, is trained on ITA’s export-related content and aims to quickly get users the information they need. The Chatbot is intended to make the benefits of exporting more accessible by understanding non-expert language, idiomatic expressions, and foreign languages.

Limitations

As a beta product, the Chatbot is currently being tested and its responses may occasionally produce inaccurate or incomplete information. The Chatbot is trained to decline out of scope or inappropriate requests. The Chatbot’s knowledge is limited to the public information on the Export Solutions web pages of Trade.gov, which covers a wide range of topics on exporting. While it cannot provide responses specific to a company’s product or a specific foreign market, its reference pages will guide you to other relevant government resources and market research. Always double-check the Chatbot’s responses using the provided references or by visiting the Export Solutions web pages on Trade.gov. Do not use its responses as legal or professional advice. Inaccurate advice from the Chatbot would not be a defense to violating any export rules or regulations.

Privacy

The Chatbot does not collect information about users and does not use the contents of users’ chat history to learn new information. All feedback is anonymous. Please do not enter personally identifiable information (PII), sensitive, or proprietary information into the Chatbot. Your conversations will not be connected to other interactions or accounts with ITA. Conversations with the Chatbot may be reviewed to help ITA improve the tool and address harmful, illegal, or otherwise inappropriate questions.

Translation

The Chatbot supports a wide range of languages. Because the Chatbot is trained in English and responses are translated, you should verify the translation. For example, the Chatbot may have difficulty with acronyms, abbreviations, and nuances in a language other than English.
