China Auto Industry Data Security

China released the “Auto data security compliance and practice guidance” on January 5, 2023. This aims to give automakers guidance on how to protect data, which are collected from automobiles as they become more “intelligent and smart”. This is the first guidance specifically drafted for the automobile industry since 2021 when the Cybersecurity Law, Data Security Law, and Personal Information Protection Law all came into effect. 

Given the large amount of data involved in its industry chain, the automotive industry has become one of the most regulated industries in China’s efforts to complete its data governance system. This document gives clear guidance on how to collect, process, and protect data collected from automobiles, as well as how to protect personal information and handle data storage. It also clearly illustrates how to carry out cross-border data transfer security reviews.
