Antidumping and Countervailing Duty Operations
The Antidumping and Countervailing Duty Operations Unit is responsible for enforcing U.S. antidumping duty (AD) and countervailing duty (CVD) laws. AD/CVD Operations conducts investigations in response to petitions received by the Department from domestic industries and/or labor unions. AD/CVD Operations also conducts subsequent proceedings known as administrative reviews in which importers’ actual duty liability is assessed. In general, AD proceedings determine whether foreign producers/exporters are selling merchandise in the United States at less than fair value (commonly referred to as “dumping”); CVD proceedings determine whether foreign governments are unfairly subsidizing their producers/exporters. Most of our staff is housed within seven offices tasked with conducting comprehensive analyses and making recommendations to the Assistant Secretary for Enforcement and Compliance. In addition to AD/CVD casework, the Customs Unit within AD/CVD Operations serves as the E&C liaison with U.S. Customs and Border Protection (CBP) on matters pertaining to the collection of AD/CVD duties and issues of potential fraud associated with AD/CVD proceedings.
Working in close coordination with AD/CVD Operations, the Office of Operations Support serves interested parties in trade remedy proceedings through its administration of ACCESS, E&C’s electronic document filing system, and management of administrative protective orders and procedures. Operations Support also provides central recordkeeping services for trade remedy proceedings and maintains E&C’s public reading room.
AD/CVD Proceedings, Case Management and Information:
AD/CVD Enforcement Offices: The vast majority of the staff is comprised of international trade analysts who, on a day-to-day basis, conduct investigations and administrative reviews. In doing so, they analyze detailed information provided by foreign producers and exporters (and governments in CVD cases) in response to questionnaires issued to them. In AD proceedings, such information includes sales made by a company over a specified period of time and the selling and production expenses associated with them. In CVD proceedings, the information includes data on benefits conferred by governments on their producers and exporters. That information is used to determine the levels of dumping and/or unfair subsidization. When companies are found to have been dumping and/or have received unfair subsidies, and the U.S. International Trade Commission finds that the relevant U.S. industry has been materially injured, or threatened with material injury, as a result of the unfairly-traded imports, AD/CVD Operations instructs CBP to collect duties equal to the amount of dumping or subsidization. AD/CVD Operations also conducts anti-circumvention inquiries when there is evidence that producers/exporters are attempting to avoid the payment of AD/CVD duties. In addition, AD/CVD Operations conducts scope inquiries when a party is unsure whether a particular product should be subject to AD/CVDs.
Customs Liaison Unit (CLU): Serves as the liaison between E&C and U.S. Customs and Border Protection (CBP) on issues involving the suspension of entries and the collection and assessment of AD/CVDs. The CLU also maintains a call center where the importing public can seek clarification on E&C’s cash deposit and assessment instructions to CBP. Additionally, the CLU serves as the bridge between E&C, CBP, and other Department of Homeland Security agencies on matters related to fraud and evasion of AD/CVD orders and assists with the transfer of information between the two agencies.
Office of Operations Support: Assists authorized representatives in protecting business proprietary information submitted in the Department’s antidumping duty (“AD”) and countervailing duty (“CVD”) proceedings.
APO – The APO is the mechanism under which the Department regulates and insures the security of proprietary information released to APO authorized representatives involved in AD/CVD proceedings. The APO Unit within Operations Support can assist you with understanding the APO requirements contained and suggest procedures firms can employ internally to protect business proprietary information they receive under an administrative protective order (“APO”) in the course of a proceeding.
ACCESS – The antidumping duty and countervailing duty centralized electronic service system is the repository for all documents filed in an AD/CVD proceeding conducted by the U.S. Department of Commerce, Enforcement and Compliance (EAC). ACCESS provides the capability for registered E-Filers to submit documents to the record of an AD/CVD proceeding, as well as search for and view all Public Documents and Public Versions in the system. Registered Guest Users may search for and view Public Documents and Public Versions.
